EVA STUDIOS PROJECT TERMS AND CONDITIONS

Throughout the below terms and conditions, the terms “we”, “us” and “our” refer to EVA Studios. By commissioning a piece or otherwise engaging in a purchase from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and available in the general website Terms and Conditions.
1. No finished work will be sent before full payment has been received by EVA Studios. If payment is not received 30 days from the issue date of the invoice, the painted miniatures will become property of EVA Studios. The project deposit will not be refunded.

2. Purchase of miniatures and specialist materials may be organised through EVA Studios and will be charged at local RRP unless alternate sources are available.

3. A deposit must be paid before work starts on any project, or before any materials have been purchased by EVA Studios. This deposit becomes non-refundable once work has begun on the project. Any miniatures that have not been worked on can be returned at shipping cost to the client.

4.If a project is cancelled after commencement, a cost will be provided upon request to purchase the models back at a cost based on the amount of time spent on the model at the time of cancellation.

5. We reserve the right to refuse service to anyone for any reason at any time.

6. Repainting or repairing used miniatures is done on a case by case basis, and may be refused down depending on the condition of the model. Due to the complex nature of some fully assembled models, an additional fee may be charged.

7. Whilst we are happy to use any reference imagery that is provided as a guide, EVA Studios will not directly copy any other artist’s style or designs. This is out of respect for other miniature artists and the considerable work that goes into developing a style.

8. Unless organised prior to the commencement of work, spare pieces from model kits will be retained by EVA Studios.

9. Whilst all care will be taken when shipping miniatures to their destination, EVA Studios will not take responsibility for damages caused by rough handling by postal or courier services. If the damage is significant, please get in touch as we are happy to communicate with you to try and find a solution.

10. If any substantial changes are made to the project after commencement (including downgrading or downscaling a project), a $100 change fee will be added immediately to the cost of the commission to make up for any rescheduling or changes in the commission process that must to be done to accommodate your request. Please make sure that you are committed to your decisions before commencement of the project

11. Despite our best efforts to maintain a schedule, miniature painting is a creative process and will be subject to delays caused by other projects, weather conditions that may affect the paint or other unforseen factors. Each project is hand created with the recipient in mind, and not produced for fast commercial sale.

12. Commercial projects will be considered on a case by case basis, with consideration to commercial use licensing fees. Email admin@evastudios.com.au for more information.

13. Recast models will be turned down for painting services. Recasting actively harms the hobby community and EVA Studios does not support the practice. If a model is determined to be a recast after the project has commenced, we reserve the right to cease work on the project immediately.

14. We reserve the right to update these terms and conditions as necessary with due notice to those who would be affected at the time of the change, as determined by holding an active project agreement with EVA Studios.

15. The failure of us to exercise or enforce any right or provision of these Terms and Condtions shall not constitute a waiver of such right or provision.
